PRIVACY POLICY

This privacy policy governs your use of the Pixels Matter (“PM”) websites and mobile applications (“Application”). The Application includes tracking-related services and content.

What information does the application obtain and how is it used?

User Provided Information. This Application obtains the information the user (“user” and/or “you”) provide when you download and register the Application. Registration with PM is mandatory in order to be able to use the basic features of the Application. When you register with PM and use the Application, you generally provide your name, address, email address and password, and phone number. If you purchase any products and services, PM collects billing and credit card information. This credit card information is used to complete the purchase transaction and is stored with a third-party service provider not PM.

Automatically Collected Information. In addition, the Application may collect certain information automatically such as the type of mobile device you use, your mobile device unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile internet browsers you use, and information about the way you use the Application.

How User Provided and Automatically Collected Information is Used. The user provided and automatically collected information is used by PM to enable the features, including location services, of the Application and to personalize the services offered by PM or its affiliates. It is also used to assess and enhance the performance of the Application or other on-line services, provide technical support and respond to your needs. It may also be used to contact you from time to time to provide you with important information, required notices and marketing promotions.

Does the Application collect precise real time location information of the device? 
This Application collects precise information about the location of your device using functions included in the software development kit provided to PM by your mobile device's operating system. PM references your location when you navigate to a part of the Application that requires location data in order to function and PM uses your location information to provide requested location services. You may at any time opt-out from further allowing PM to have access to your location data by turning off the location services for the Application under the Privacy Settings of your mobile device. For more information, please see the section below entitled “opt-out rights.”

Do third parties see and/or have access to information obtained by the Application? 
Yes. PM shares your information with third parties only in the ways that are described in this privacy statement. PM may disclose User Provided and Automatically Collected Information:

- as required by law, such as to comply with a subpoena or similar legal process;

- disclosure is necessary to protect PM rights, protect your safety or the safety of others, investigate fraud or respond to a government request;

- with PM services providers who do not have an independent use of the information disclosed to them and have agreed to adhere to the rules set forth in this privacy statement;

- with other entities directly or indirectly affiliated with, under common ownership with, and/or owned or operated by PM; and

- if PM is involved in a merger, acquisition, or sale of all or a portion of its assets, a notice will be posted on the Application of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

What are my opt-out rights? 

Opt-out of all information collection by uninstalling the Application. At any time, you may stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall process provided by your mobile device or via the mobile application marketplace or network.

Location Information. At any time, you may opt-out from further allowing us to have access to your location data by turning off the location services for the Application under the Privacy Settings of your mobile device.

Data Retention Policy, Managing Your Information.
PM will retain User Provided and Automatically Collected Information for as long as you use the Application and for a reasonable time thereafter. If you'd like us to delete User Provider Information that you have provided via the Application, please contact us at privacy@pixelsmatter.com. Please note that some or all User Provided Information may be required in order for the Application to function properly, and we may be required to retain certain information by law.

California Privacy Policy

Under California Law, California residents have the right to request, in writing, from businesses with whom they establish a business relationship, (a) a list of the categories of personal information, such as: name, email, mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes and (b) names and addresses of all such third parties. PM will respond to such requests to information access within thirty (30) days following receipt at the email or mailing address stated above. If PM receives your request at a different email or mailing address, PM will respond within a reasonable period of time, not to exceed 150 days from the date received. Please note PM is only required to respond to each customer once per calendar year. PM treats everyones’ data in accordance with this privacy policy, whatever their Do Not Track setting.

Children.
PM does not use the application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware their child has provided PM with information without their consent, he or she should contact us at legal@pixelsmatter.com. PM will delete such information within a reasonable time.

Security. 
PM is concerned about safeguarding the confidentiality of your information. PM provides physical, electronic, and procedural safeguards to protect information processed and maintained. For example, PM limits access to this information to authorized employees and contractors who need to know the information in order to operate, develop or improve the Application. Although PM endeavors to provide reasonable security for information processed and maintained, no security system can prevent all potential security breaches.

Changes. 
This Privacy Policy may be updated from time to time for any reason. PM will notify you of any changes to the Privacy Policy with updates at www.pixelsmatter.com. You are advised to consult this Privacy Policy regularly for any changes.

Your Consent. 
By using the Services, you consent to PM processing of User Provided and Automatically Collected Information as set forth in this Privacy Policy now and as amended by PM. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining, and disclosing information, all of which activities will take place in the United States. If you reside outside the United States, your information will be transferred to the United States and processed and stored there under United States privacy standards. By using the Application and providing PM information, you consent to such transfer to, and processing in, the United States.
